1. Acceptance of Terms
By accessing or using Kulmia services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
Kulmia provides lead capture, lead audit, and business automation services for independent and legacy businesses. Services include web-based lead forms, a lead management dashboard, and automated response notifications.
3. Client Responsibilities
Clients are responsible for ensuring that their use of Kulmia complies with all applicable local, provincial, and federal laws. This includes compliance with anti-spam legislation (CASL), consumer protection laws, and professional regulatory requirements applicable to their industry (e.g., Law Society rules, CPSO regulations for medical practices).
4. Data Ownership
All lead data collected through your Kulmia account belongs to you. Kulmia does not claim ownership over your client data. You grant Kulmia a limited license to store and process this data solely for the purpose of providing the service.
5. Service Availability
Kulmia strives for 99.9% uptime but does not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We are not liable for damages resulting from service interruptions.
6. Payments & Refunds
All fees are billed as described in your selected plan. Monthly plans may be cancelled at any time; cancellation takes effect at the end of the current billing period. One-time fees are non-refundable once work has commenced.
7. Limitation of Liability
To the maximum extent permitted by law, Kulmia shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability shall not exceed the fees paid in the three months preceding the claim.
8. Governing Law
These terms are governed by the laws of the Province of Alberta, Canada. Any disputes shall be resolved in the courts of Edmonton, Alberta.
